Section 12A Registration
Section 12A (now Section 12AB after Finance Act 2020) of the Income Tax Act provides income tax exemption to charitable and religious organizations — trusts, societies, and Section 8 companies. Once registered, the organization's surplus income applied for charitable purposes is exempt from income tax.

Eligibility

Documents Required
- Registration certificate of the organization (Trust Deed / MoA / Bye-laws).
- Self-certified copy of activities and objectives of the organization.
- Audited financial statements for the last 3 years (if the organization is more than 3 years old).
- PAN Card of the organization.
- Activity report demonstrating charitable work undertaken.
- Details of trustees/directors — PAN and Aadhaar.
Registration Process
- File Form 10A on the Income Tax e-filing portal for provisional registration (new organizations) or Form 10AB for permanent registration.
- Upload all required documents including registration certificate and financial statements.
- Commissioner of Income Tax (Exemptions) reviews the application.
- If found in order, a Provisional Registration (3 years validity) or Permanent Registration (5 years validity, renewable) is granted under Section 12AB.
- After 3 years of activity under provisional registration, apply for permanent registration.
Timeline
Approximately 30–90 days from application filing, depending on the Income Tax Department's processing time.
